1. General points

Innoval cares about the protection of your personal data, which is the subject of this « Personal data protection policy » document.

For reasons of convenience, the following terms in bold are defined as follows:

  • « INNOVAL » refers to our Innoval agricultural cooperative society with variable capital, approved by the High Council for Agricultural Cooperation (HCCA) under number 10457 and registered with the Rennes RCS under number 305 321 929 and whose registered office is located at Rue Éric Tabarly – CS 80038, 35538 Noyal-Sur-Vilaine Cedex.
  • « EasyFoal » refers to the monitoring product marketed by Innoval, which is the subject of the Site and over which Innoval has industrial property rights and marketing rights. More specifically, EasyFoal is a foaling detection system based on an analysis of the mare’s pre-foaling behaviour.
  • « Data » refers to your personal data, as defined in Article 4 of the GDPR and described below.
  • « LIL » refers to French Act No. 78-17 of 6 January 1978, known as the Data Protection Act, as amended.
  • « Policy » refers to this personal data protection policy.
  • « GDPR » refers to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data;

Therefore, your Data are processed securely and in accordance with the applicable French regulations and legislation in this area, in particular the GDPR and LIL.

This Policy is intended to present the ways in which Innoval processes your Data in particular as part of your use of the Site.

 

2. Data controller and contact

You can contact the customer service department at any time; it will transfer your request to the relevant GDPR advisor. To do so, either send an email to : service.clients@innoval.com or send a letter by post to the address of Innoval’s registered office.

They will reply to you as quickly as possible, within a maximum period of 30 (thirty) days from the date of receipt of your request or, where applicable, the date of receipt of proof of your identity.

 

3. Legal grounds of Data processing

Innoval may process Data, which primarily involves the collection, recording, organisation, structuring, storage, use and distribution of these Data:

  • To fulfil a legal obligation;
  • Or in the context of preparing an estimate (pre-contractual phase);
  • Or in performance of a contract and more broadly of a business relationship, in particular performance of the general terms of use (GTU), general terms of sale (GTS) and rules of procedure;
  • Or with the explicit consent of the person concerned (example: contact form through the “By ticking this box, I agree that my personal data may be used to allow the Innoval agricultural society to reply to me” check box, referring to this privacy policy);
  • Or on the grounds of legitimate interests, in particular the promotion of its products to its customers (products similar to that/those previously ordered by an Innoval customer); Or in the event of suspected or attempted fraud on the Site.

 

4. Data likely to be processed

  • Innoval is liable to collect and process the Data of its customers, its prospects and its contacts on agricultural holdings and more generally the Data of the Site’s users.
  • Innoval only processes those Data required for the purposes of the processing operation in question.
  • Certain data are collected directly from you (a), others automatically (b), and still others indirectly (c).

 

A - Data collected directly from you

Consent to the processing of your Data is collected directly and explicitly from you. You can exercise your rights as described in Article 9 below at any time.

In the event that your Data are collected through a form, an asterisk will inform you of whether the information is mandatory or optional (*) next to required fields.

C - Data collected indirectly

Innoval is liable to indirectly collect your personal Data in particular by entering into partnerships as part of R&D projects or by assimilating third-party databases.

In all cases, Innoval undertakes to comply with the provisions of Article 14 of the GDPR.

 

5. Purposes of Data processing

Your Data are collected and processed for the following purposes:

  • execute the contract signed with Innoval;
  • promote and showcase Innoval’s activities through its EasyFoal product;
  • run the Site;
  • write articles;
  • maintain the link between the Data owner and Innoval;
  • optimise your browsing experience on the Site;
  • answer your requests:
    • for information through the contact form on the Site
    • based on the exercise of your rights (Article 9 below)
  • and other purposes in keeping with the above purposes including the organisation of prospecting operations consistent with our activities.

 

6. Recipients of the Data

 

A - The Data collected on the Site are intended for:

  • INNOVAL;
  • partners with which Innoval has signed a contract requiring compliance with the legal provisions on the protection of personal data;
  • Innoval’s subcontractors.

 

B - Transmission:

Data may be transmitted to the subcontracting companies that Innoval calls on for the performance of services, to the extent necessary for the accomplishment of the tasks entrusted to them. These may include the following activities:

  • hosting;
  • outsourcing.

 

C - INNOVAL:

  • ensures that its staff and subcontractors comply with the current regulations on Data protection and with this Data protection policy;
  • requires that its subcontractors and staff pay special attention to the confidentiality and security of Data.

 

7. Period of data retention

We retain your Data for as long as we are required to do so under the current legislation and for the purposes set out above.

When you have terminated your use of our services, we may store your Data in an aggregated or anonymised format.

Furthermore, notwithstanding the aforementioned periods, we may also retain your Data as reasonably necessary to comply with our legal obligations, resolve disputes and take them to court, and enforce our agreements.

 

8. Data security and storage

Innoval undertakes to ensure the security and confidentiality of your Data in accordance with standard industry practice, i.e. by requiring an adequate level of protection as recommended by the CNIL.

Innoval regularly tests its internal procedures in the event of technical or physical incidents in order to guarantee and maintain optimum levels of responsiveness and efficiency.

However, in light of the structure of the Internet and networks, Innoval cannot be bound by a performance obligation with regard to security. If a security flaw is identified that is likely to pose a major risk to your rights and freedoms, Innoval undertakes to inform you at the earliest possible time and take, insofar as possible, effective measures to neutralise the intrusion and minimise its impact.

Innoval makes backups of your Data on a regular basis in order to limit the impact of a security flaw.

 

9. To exercise your rights

You may, ipso jure, access the Data that we hold about you and correct, update, rectify, delete, erase or modify your Data in any other way if they are incorrect or have been processed in breach of the Data protection regulations in force.

You may also oppose the processing of your Data or exercise your right to portability.

To exercise your rights, you can send an email to the customer service department whose contact details are given in Article 2 above.

In this framework, your request should be accompanied by information required to identify you (last name, first name, email address) and any other information required to confirm your identity. If it has any doubts, Innoval may ask you for a copy of your identity card in accordance with the provisions of the applicable regulations.

Innoval undertakes to consider the exercise of your rights without delay, except when the law or a legitimate ground requires that it keep some of your Data.

Innoval reserves the right to invoice the cost associated with your request within the limits laid down by the LIL.

In the event of an unsatisfactory response, you may lodge a complaint with the French Data Protection Authority (CNIL) on https://www.cnil.fr/fr/plaintes or at the following address: Commission nationale de l’informatique et des libertés (CNIL) - 3 place de Fontenoy, TSA 80715 - 75334 Paris Cedex 07.

10. Amendments to the privacy policy

Innoval reserves the right to amend this personal data protection policy, in particular to comply with the applicable legal and regulatory provisions. Innoval will add it to the Site upon its entry into force.

Innoval will make all commercially reasonable efforts to generally inform all users of substantial amendments to this Policy, in particular by posting a notice on our Site.

Nevertheless, you should refer to this Policy on a regular basis. For easier monitoring, we will update the “Last updated” date given at the beginning of this document, which corresponds to the effective date of our Data protection policy.

By continuing to access or use our services after the “Last updated” date, you are accepting the changes made.
